This position is responsible for serving as a legal practice leader and expert for employment, labor and benefits within the Company. This position is responsible for managing attorneys and related staff in providing legal counsel, direction and support to various corporate divisions, subsidiaries, and affiliate companies regarding the legal implications of ongoing and proposed changes in employment, labor and benefit practices. This position may directly handle the most complex legal matters or projects of a practice. Please note, this position is a hybrid flex role that requires in-office hours 3 days a week at the respective location.

Job Responsibilities:

  • Provide leadership for the employment, labor and benefits legal practice within HCSC.  Manages attorneys and provides complex legal counsel and direction in Legal representation concerning employment practices, EEOC complaints, union and collective bargaining, wage and hour disputes, benefits and compensation, employment due diligence for corporate transactions, and related human resource matters.

  • The role is also responsible for ensuring compliance with federal, state, country, and local employment laws and regulations. This includes reviewing and drafting employment contracts, policies, and handbooks.

  • In partnership with Human Resources, the managing counsel will conduct training sessions or workshops for managers and employees while ensuring compliance with employment laws and advise and guide managers on best practices related to investigations and provide resolution on other employee relations matters.

  • Provide functional advice, training and guidance to other HCSC attorneys when assigned.

  • Consistently demonstrate leadership, tact, and diplomacy within the HCSC Legal Division with professional peers and on legal assignments/projects.

  • Exercise tact and diplomacy in day-to-day accountabilities, including interactions with corporate and legal management and in negotiations with other entities while representing and protecting the interests of HCSC.

  • Advise management on complex legal matters, ensuring compliance with federal and state laws.

  • May assume responsibilities of and/or represent the Chief Legal Officer on matters relating to assigned areas of accountability.

  • Delegate tasks and assignments across staff to ensure appropriate level and type of expertise required for legal issues.

  • Keep abreast of all pertinent laws, trends, court rulings, etc., as they relate to areas of concern to management or to issues for which legal advice is provided.

  • Make presentations to Company personnel on legal, regulatory and Company policy matters.

  • Communicate and interact effectively and professionally with co-workers, management, customers, etc.

  • Comply with HIPAA, Diversity Principles, Corporate Integrity, Compliance Program policies and other applicable corporate and departmental policies.

  • Maintain complete confidentiality of company business.

  • Maintain communication with management regarding development within areas of assigned responsibilities and perform special projects as required or requested.          

Required Job Qualifications:

  • Law degree and license to practice law in the state where the legal department is located.

  • 10 years legal experience, including insurance, corporate, health care law, regulatory, litigation, legislative.

  • 2 years leadership experience.

  • Experience in Employment/EEOC/compliance tactical and settlement recommendations at HCSC, another corporate law department, or private practice

  • Strong verbal and written communication skills.

  • Demonstrated ability to think strategically on legal and business issues, to deliver quality and timely legal services.

  • Highly developed judgment skills and abilities.

Preferred Job Qualifications:

  • 15 years legal experience, including insurance, corporate, health care law, regulatory, litigation, legislative.

  • Five years of legal experience within the HCSC Legal Division is preferred.

  • Employment and labor legal experience working in large scale enterprise organizations.
